Terms and Conditions — RentCarChile SpA

These terms and conditions govern all vehicle rental services provided by RentCarChile SpA. Please read this document before booking. By confirming a reservation, you declare that you have read, understood, and expressly accepted all the conditions set forth herein.

General booking conditions

Booking confirmation

A booking is not final until we confirm the vehicle, dates, pickup or delivery option, and price with you in writing by WhatsApp or email. Some areas, routes, or vehicle requests require extra confirmation after submission.

Delivery and prepayment

We deliver the vehicle only after the booking is confirmed and all agreed pre-handover amounts are paid, including the delivery fee and any required rental prepayment. Until then, delivery time and address are not guaranteed.

Pickup and prepayment

We release the vehicle for pickup only after the booking is confirmed and all agreed pre-handover amounts are paid, including any applicable pickup-related fee and any required rental prepayment. Until then, pickup time and location are not guaranteed.

Payment

Only reservations paid in full or in part, as agreed with us, can secure the selected vehicle. Unpaid requests remain subject to availability. Payment methods and timing depend on the case, including eligible rentals without a credit card.

Security deposit (guarantee)

A refundable security deposit applies. The amount and form depend on the vehicle, insurance option, and extras. After return, we start the refund or release within 7 to 30 business days once the car has been received, inspected, and no outstanding charges remain (such as fuel, TAG/tolls, fines, damage, cleaning, or late return), unless the rental contract states a different timeframe. For cancellations or other refunds, processing takes up to 15 business days from the date the request is properly received through official channels. Bank or card processing times may extend this further and are not under our control.

Return and inspection

The vehicle must be returned on the agreed date, time, and place, in the same condition shown on the signed Delivery/Reception form, except for normal wear. Fuel level must match delivery level unless refuelling charges apply. Extra cleaning may be charged if needed. If the vehicle is too dirty to inspect, final inspection and deposit release may be delayed until cleaning is completed.

Your responsibility

The renter is responsible for lawful use of the vehicle, compliance with Chilean traffic rules, fines, tolls, and sanctions arising during the rental period, including those notified after return for events that occurred while the vehicle was in the renter’s possession. Responsibility also includes damage or loss caused by negligence or misuse, use by unauthorized drivers, and any deductibles or limits defined in the contract. Late return may lead to extra charges. Early return does not automatically generate a refund unless we confirm it in writing.

Daily rental conditions

Requirements and Mandatory Documentation for the Rental

Minimum age and experience

The minimum age to rent a vehicle is 21 years old at the time the vehicle is delivered.

Drivers between 21 and 24 years of age may be subject to additional conditions, such as a higher security deposit or vehicle-category restrictions, at Rent Car Chile's sole discretion.

Mandatory driver documentation

Valid driver's license, valid for use in Chile.

Valid national ID card or valid passport.

Drivers with less than 2 years of driving experience may have their request denied at Rent Car Chile's sole discretion.

Additional requirements for tourists

Foreign tourists must present the Proof of Entry into the country issued by the Chilean Investigative Police (PDI), in physical format, valid for the entire rental period. Digital copies or photographs are not accepted.

Rental Guarantee / Security Deposit

The amount and type of security deposit required will depend on the vehicle category, insurance option selected, and any additional items or services included in the rental.

Rent Car Chile will initiate the refund or release of the security deposit within 7 to 30 business days after the vehicle is returned, unless the contract states a different timeframe, provided that:

The actual time required for the customer to receive the refunded amount will also depend on the type of guarantee provided and the processing times and policies of the relevant bank, card issuer, or financial institution. Once Rent Car Chile has processed the release or refund, any additional waiting period shall be the sole responsibility of the corresponding financial institution.

If, at the time of return, the vehicle is excessively dirty, covered in mud, sand, or otherwise in a condition that prevents a proper inspection, Rent Car Chile may postpone the final inspection until the vehicle can be adequately cleaned and reviewed. In such case, the refund or release process may also be delayed accordingly.

The renter expressly authorizes Rent Car Chile to apply all or part of the security deposit, without further notice or additional formalities, to cover any amounts owed under the rental agreement.

If the security deposit is insufficient to cover the total amount due, the renter expressly authorizes Rent Car Chile to charge the outstanding balance to the credit or debit card provided as guarantee, where legally and operationally possible.

If the guarantee was provided by any other payment method, the renter must pay any outstanding balance within 5 business days from the date of notification by Rent Car Chile.

If the renter fails to make the required payment within that period, Rent Car Chile may pursue collection through extrajudicial and/or judicial means, and any collection costs, legal fees, interest, and related expenses permitted by applicable law shall be borne by the debtor.

Coverage

Coverage mentioned below will only apply within Chilean territory and will not be applicable in cases of negligence, fault, or willful misconduct on the part of the renter and/or vehicle driver. Additionally, coverages are not applicable in cases of faults and/or violations of the current traffic regulations in the Republic of Chile.

The minimum security guarantee for the rental is CLP 600,000.

Civil Liability — Mandatory civil liability coverage for third parties, with a cap of 1,000 UF.

Damage — Coverage for damages to the rented vehicle. The maximum charge to the renter per event is 15 UF + VAT, unless the rental contract states otherwise.

Collision — Coverage for collision under the responsibility of the driver designated in the contract. The maximum charge to the renter per event is 15 UF + VAT, unless the rental contract states otherwise.

Rollover — Coverage in case of rollover, under the responsibility of the driver designated in the contract. The maximum charge to the renter per event is 15 UF + VAT, unless the rental contract states otherwise.

Theft — Coverage in case of theft, under the responsibility of the driver designated in the contract. The maximum charge to the renter per event is 15 UF + VAT, unless the rental contract states otherwise.

Not covered by insurance (charged in full to the renter at return):

Windshield, glass, and locks.

Mirrors.

Loss of or damage to keys.

Tires and rims.

Conditions of vehicle use

The vehicle must be used lawfully, in compliance with the traffic laws of Chile, and only by the drivers authorized in the rental contract. The following are strictly prohibited: subleasing, lending, or transferring the vehicle to unauthorized third parties; commercial passenger transport, rideshare, or delivery services; participation in races or any unlawful activity; driving under the influence of alcohol, drugs, or any substance that impairs the ability to drive; and off-road or unsuitable-terrain use without prior written authorization from Rent Car Chile. Breach of these conditions automatically voids any applicable coverage, entitles Rent Car Chile to terminate the contract immediately without refund, and leaves the renter fully liable for all resulting damages, fines, and costs.

Cross-border travel and exit from Chilean territory

Cross-border travel and exit from Chilean territory with the rented vehicle are not included in the standard rental. Any international exit requires a specific cross-border permit, contracted as a paid additional service, requested, confirmed in writing, and paid before the rental starts and the vehicle is delivered. Exiting Chilean territory without a valid permit constitutes a material breach of contract, immediately voids all insurance coverage, and makes the renter fully liable for all resulting damages, fines, recovery costs, and legal costs, without prejudice to any civil and criminal actions that may apply.

Vehicle substitution

Rent Car Chile reserves the right to substitute the reserved vehicle with another of equivalent or higher category, at no extra charge to the renter, for operational reasons, maintenance, mechanical failure, prior accident, unavailability, or force majeure. Specific characteristics (color, optional equipment, exact model) do not constitute a contractual guarantee, unless expressly agreed in writing. In cases of force majeure or no equivalent vehicle being available, Rent Car Chile may offer a proportional refund for the days not provided, with no further obligation.

Accident, Theft, or Robbery

In the event of an accident, theft, robbery, or any other incident affecting the vehicle, the renter shall be obligated to comply strictly with the following procedure:

The renter must immediately report the event to the competent authority and, where applicable, file the corresponding police report, complaint, or sworn statement before Carabineros de Chile or the authority legally competent to receive such report.

In addition, the renter must submit to Rent Car Chile a complete sworn statement describing the circumstances of the event within a maximum period of 24 hours counted from the time the incident occurred.

Such statement must include, whenever applicable, all available information relating to the event, including but not limited to:

The renter shall also provide, whenever possible, photographs or other evidence of the scene, the condition of the vehicle, and the damages sustained.

Failure by the renter to comply fully and timely with the foregoing obligations, or the omission, concealment, distortion, or inaccuracy of relevant information, shall entitle Rent Car Chile to hold the renter fully liable for all resulting losses and damages, including but not limited to:

In such case, Rent Car Chile shall be entitled to charge the corresponding amounts to the credit or debit card indicated in the rental agreement, apply the security deposit, and/or demand payment by any other legally valid means, without prejudice to any further contractual or legal actions that may apply.

Likewise, in all cases, any coverage, deductible, limitation of liability, or protection plan contracted by the renter shall apply only if the renter has complied fully with all contractual obligations, reporting duties, documentation requirements, and instructions issued by Rent Car Chile. Otherwise, such coverages or limitations may become inapplicable, and the renter shall bear the full cost of the damages and related losses.

Return of the Vehicle and Additional Charges

The renter shall return the vehicle in the same condition in which it was delivered, as recorded in the corresponding Delivery/Reception Form, which is signed by the renter at the time of vehicle handover.

Any difference in the condition of the vehicle between delivery and return, including but not limited to damages, missing items, excessive dirtiness, missing documents, missing accessories, or any deterioration not attributable to normal wear and tear, and which is not covered by the contracted protections or coverages, shall be charged in full to the renter.

The renter shall be solely responsible for removing all personal belongings from the vehicle at the end of the rental period. Rent Car Chile shall not be liable for the loss, theft, damage, or misplacement of any personal items left inside the vehicle after its return.

Additional Charges Applicable to the Rental

1. Delay in Return

The renter shall return the vehicle on the date, time, and place agreed in the rental agreement. A grace period of one (1) hour shall apply exclusively at the discretion of Rent Car Chile. Once such period has elapsed, Rent Car Chile may charge, as applicable: the corresponding extra-hour charge; or an additional full rental day, depending on the length of the delay, operational impact, vehicle availability, and the applicable rate conditions. The application of the grace period shall not be interpreted as a waiver by Rent Car Chile of its right to charge for late return.

2. Fuel

Fuel is not included in the rental rate, unless expressly stated otherwise in writing. The vehicle shall be delivered with the fuel level indicated in the Delivery/Reception Form, and the renter must return it with the same fuel level. If the vehicle is returned with less fuel than recorded at delivery, Rent Car Chile shall be entitled to charge the renter for: the missing fuel; the refueling service; and any related operational or administrative costs. The typical total surcharge ranges from CLP 45,000 to CLP 165,000, depending on the missing volume. No refund is provided if the vehicle is returned with more fuel than originally delivered.

3. Cleaning / Car Wash

The vehicle must be returned in reasonably clean condition, consistent with normal use. If the vehicle is returned with excessive dirt, mud, sand, stains, odors, animal hair, waste, or any condition requiring special or extraordinary cleaning, Rent Car Chile may apply an additional cleaning charge, the amount of which shall be determined according to the condition of the vehicle and the cleaning required, with a minimum of CLP 30,000 and up to CLP 400,000 when chemical or specialized cleaning is required. If the state of cleanliness prevents proper inspection of the vehicle at the time of return, Rent Car Chile may postpone the final inspection until the vehicle is adequately cleaned, without prejudice to any charges that may apply.

4. Rental Extensions

Any extension of the rental period must be requested by the renter directly through the office of pickup, the reservations center, or any other official channel authorized by Rent Car Chile. All rental extensions shall be subject to prior authorization and vehicle availability. Rent Car Chile shall have sole discretion to approve or reject any extension request. Any approved extension may generate additional charges according to the rates, conditions, and operational requirements in force at the time of the request. The renter must pay the full amount of any approved extension within a maximum period of 24 hours from the time of approval or request, as determined by Rent Car Chile. If payment is not made within such period, Rent Car Chile may require the immediate return of the vehicle, without prejudice to any late-return charges, contractual penalties, or legal actions that may apply.

5. Fines, Infractions, and Liability for Damages

The renter shall be solely and fully responsible for all fines, penalties, sanctions, charges, and other liabilities arising from or related to violations committed during the rental period of: traffic laws; transportation regulations; municipal ordinances; toll rules; parking rules; instructions issued by Carabineros de Chile or any other competent authority; and any other applicable law, regulation, or administrative provision. Such responsibility shall apply regardless of whether the fine, penalty, or sanction is notified, issued, or made known during the rental period or after the vehicle has been returned, provided that the underlying event occurred while the vehicle was under the renter's custody, possession, or responsibility. The renter irrevocably authorizes Rent Car Chile to charge to the credit or debit card registered as guarantee, or to apply against the security deposit, all amounts corresponding to such fines, penalties, sanctions, administrative charges, collection expenses, and any associated costs attributable to the renter, even if such amounts become known or are processed after the termination of the rental agreement. Likewise, the renter shall be fully liable for all damages, losses, liabilities, costs, and expenses caused to: the rented vehicle; third-party vehicles; third-party property; and/or third-party persons, when such damages or losses arise from negligent use, improper use, unauthorized use, reckless conduct, or use contrary to the manufacturer's recommendations, the rental agreement, or applicable law. For these purposes, the renter irrevocably authorizes Rent Car Chile to charge all amounts corresponding to damages, losses, repairs, compensations, deductibles, immobilization, loss of use, towing, administrative expenses, and any other related costs attributable to the renter, to the payment method registered as guarantee and/or against the security deposit, provided that such amounts are duly documented, supported, or accredited by Rent Car Chile through the corresponding records, reports, invoices, estimates, photographs, expert evaluations, official notifications, or other reasonable means of proof. If the available guarantee or authorized payment method is insufficient to cover the total amount owed, the renter shall remain personally liable for the unpaid balance, which must be paid immediately upon request by Rent Car Chile, without prejudice to any judicial or extrajudicial collection actions that may apply.

Late payment charge

Any payment made after the agreed due date will incur a late-payment charge of 0.3 UF per delayed payment, in addition to any other amount owed under the rental contract and to any applicable collection actions.

Refund Conditions for Prepaid Reservations under Special Rates or Limited Offers

These conditions apply exclusively to reservations made under a special rate, promotional price, limited-time offer, discount, alliance benefit, third-party campaign, coupon, corporate agreement, seasonal promotion, or any other exceptional commercial condition offered by Rent Car Chile SpA, where full or partial prepayment is required as a condition of accessing such benefit.

The customer acknowledges and expressly accepts that the preferential price or special commercial condition granted to the reservation is offered subject to specific cancellation, modification, and refund restrictions, which are stricter than those applicable to standard reservations.

Accordingly, by confirming a reservation under any such special condition, the customer expressly accepts the following refund and cancellation rules:

Monthly rental conditions

The following conditions apply exclusively to rentals with a minimum duration of thirty (30) consecutive days and must be read together with the general conditions above.

1. Minimum Rental Period

The minimum rental period eligible for monthly rates is thirty (30) consecutive days. Rentals of fewer than thirty days do not qualify for monthly pricing and will be subject to the standard daily or weekly rates in force at the time of booking.

2. Eligibility and Required Documentation

2.1 Minimum Age The minimum age to rent a vehicle is twenty-one (21) years. Age is verified at vehicle delivery. Renters who are at least twenty-one (21) but under twenty-five (25) may be subject to supplementary conditions at RentCarChile's discretion, including but not limited to a higher security deposit, adjusted insurance or guarantee terms, or restrictions on vehicle category. 2.2 Mandatory Documentation — All Renters The following documents must be presented in original, valid, and undamaged form at the time of vehicle delivery: • Valid driver's license, current and unrestricted • Valid national identity document or passport 2.3 Additional Requirements — Foreign Nationals and Tourists Foreign nationals and tourists must additionally present the Proof of Entry into Chile issued by the Chilean Investigative Police (PDI), in physical format, valid on the rental start date. Digital copies or photographs of this document are not accepted. 2.4 Approval Submission of documentation does not constitute automatic approval. RentCarChile reserves the right to approve or reject any rental application based on internal evaluation criteria, without obligation to provide reasons.

3. Monthly Rates and Pricing

3.1 Rate Structure Monthly rental rates are determined by the following variables and may differ between bookings: • vehicle category and specific model • total agreed rental duration • monthly mileage plan selected at the time of booking • season, demand, and market conditions at time of booking • agreed pickup and return location and conditions 3.2 Indicative Pricing Prices displayed on the website, in promotional materials, or communicated verbally are indicative only. The confirmed rate is exclusively the rate stated in the signed rental agreement or written booking confirmation issued by RentCarChile. 3.3 Multi-Month Rentals — Payment and Discount For rentals exceeding one month, full advance payment for the entire agreed period is required before vehicle delivery. In consideration of full upfront payment, RentCarChile will apply a rate discount specific to the total rental duration, confirmed in writing at the time of booking. The applicable discount rate is determined by RentCarChile based on vehicle category, duration, and availability, and will be stated in the rental agreement.

4. Mileage Policy

Each monthly rental includes a defined mileage allowance agreed and confirmed at the time of booking. The following conditions apply: • Additional kilometers beyond the agreed monthly allowance are charged at a per-kilometer rate confirmed before contract signing. • In multi-month rentals, mileage allowances do not accumulate or carry over between months. Any unused kilometers in a given month are forfeited. • Mileage limits and the applicable per-kilometer rate for excess use are stated in the rental agreement and are binding.

5. Payment Terms

5.1 Advance Payment Monthly rentals require advance payment for the agreed rental period prior to vehicle delivery. For rentals exceeding one month, full payment for the entire contracted period is required in a single transaction before the vehicle is delivered. 5.2 Accepted Payment Methods Payment methods accepted by RentCarChile will be communicated at the time of booking. RentCarChile reserves the right to decline specific payment methods for specific reservation types. 5.3 Late Payment Any amount owed under the rental agreement that is not paid by its due date — including rental installments, additional charges, deductibles, fines, tolls, fuel, cleaning, or any other amount — accrues a late-payment charge of 0.3 UF per day of delay, without prejudice to RentCarChile's right to suspend services, terminate the rental agreement, or initiate collection proceedings, with all collection costs, legal fees, and interest borne by the debtor.

6. Security Deposit

6.1 Requirement A security deposit is required before vehicle delivery in all monthly rentals. The deposit amount is determined by the vehicle category, insurance option selected, additional services included, and customer profile as evaluated by RentCarChile. The minimum deposit is CLP 600,000 and the maximum is CLP 1,000,000. The deposit is a guarantee and does not constitute a payment toward the rental rate. It is held separately and subject to the return conditions set out below. 6.2 Refund Conditions RentCarChile will initiate the release or refund of the security deposit within 7 to 30 business days from the date of vehicle return, provided: • the vehicle has been duly received and inspected by RentCarChile • the vehicle is returned in the same condition as delivered, excluding normal wear and tear consistent with appropriate use • there are no outstanding charges or amounts owed under the rental, including missing fuel, unpaid tolls, traffic fines, vehicle damage, missing accessories or documents, and cleaning costs If the vehicle is returned in a condition that prevents proper inspection — including excessive dirt, mud, or sand — RentCarChile may postpone the inspection until the vehicle is adequately cleaned. In such case, the deposit refund process will be delayed accordingly. 6.3 Application Against Outstanding Amounts The renter expressly and irrevocably authorizes RentCarChile to apply all or part of the security deposit, without prior notice, to cover any amounts owed under the rental agreement, including charges that arise or become known after vehicle return. If the deposit is insufficient, RentCarChile is entitled to charge the outstanding balance to the registered payment method. If the guarantee was provided by another payment method, the renter must settle the balance within 5 business days of written notification. Failure to pay within that period entitles RentCarChile to initiate extrajudicial and/or judicial collection proceedings, with all collection costs, legal fees, and interest borne by the debtor. 6.4 Processing Times Once RentCarChile has processed the deposit release or refund, the date on which funds become available to the renter depends exclusively on the policies and processing times of the relevant bank, card issuer, or payment processor.

7. Cancellation, Modification, and Refunds

7.1 Standard Reservations The following conditions apply to reservations made at the regular published rate, without any promotional or special commercial condition: • More than 30 days before scheduled pickup — 0% — full refund • Between 48 hours and 30 days before pickup — 5% of total reservation value • Less than 48 hours before pickup — 10% of total reservation value • No Show — no prior notice provided — 100% — no refund 7.2 Special Rate, Promotional, and Limited-Offer Reservations These conditions apply to reservations made under a promotional price, limited-time offer, discount, coupon, corporate agreement, alliance benefit, seasonal promotion, or any other special commercial condition where prepayment is required to access the benefit. By confirming such a reservation, the customer expressly accepts stricter cancellation conditions in exchange for the preferential rate: • More than 30 days before scheduled pickup — 0% — full refund, unless the specific offer states otherwise • Between 48 hours and 30 days before pickup — 20% of total reservation value • Less than 48 hours before pickup — 40% of total reservation value • No Show — no prior notice provided — 100% — no refund Where a specific promotion includes its own cancellation rules, those rules prevail. 7.3 Failure to Meet Rental Requirements If the customer is unable to complete the rental at the time of scheduled vehicle delivery due to failure to present required documentation or satisfy any necessary rental condition — including a valid driver's license, valid identity document, valid security deposit, or any other previously communicated requirement — RentCarChile may retain 40% of the total reservation value, deducted from any refund otherwise applicable. 7.4 Unused Days and Early Return No refund is issued for prepaid rental days or periods not used, whether in whole or in part. Early return of the vehicle after the rental has commenced does not entitle the renter to a refund for unused days, unless RentCarChile expressly agrees otherwise in writing. 7.5 Cross-Border Permits and Special Authorizations Amounts paid for cross-border permits or special authorizations are non-refundable in all cases, unless RentCarChile expressly states otherwise in writing. 7.6 Delivery and Special Logistics Services Cancellation or modification of delivery, airport handover, hotel handover, or similar logistics services must be requested at least 3 hours in advance. Cancellations with less than 3 hours' notice may incur a charge of 20% of the service value, or the full actual cost incurred, whichever is higher. 7.7 Refund Method and Processing Time Approved refunds are returned to the same payment method used for the original transaction within up to 15 business days from the date the cancellation request is properly received with all required information. The date on which funds reach the renter depends on the processing times of the relevant financial institution.

8. What Is Included in the Monthly Rate

Unless expressly stated otherwise in the rental agreement, the monthly rate includes: • insurance coverage as specified in Section 10 • vehicle registration and circulation permit valid for the rental period • scheduled maintenance services required during the rental period, coordinated by RentCarChile • normal wear and tear resulting from appropriate and lawful use

9. What Is Not Included

The following are not included in the monthly rental rate and are the sole financial responsibility of the renter: • fuel of any type • tolls, TAG charges, parking fees, and road or infrastructure charges • traffic fines, penalties, and administrative sanctions of any nature • additional authorized drivers • optional insurance upgrades • excess mileage charges • delivery or return outside agreed conditions • cross-border permits and border crossing authorizations (available as an additional paid service — see Section 12) • windshield, glass, and lock damage or breakage • mirror damage • loss of or damage to keys • tire and rim damage

10. Insurance and Coverage

10.1 Territorial Scope All coverages described below apply exclusively within the territory of the Republic of Chile. No coverage of any kind applies outside Chilean territory. 10.2 General Exclusions No coverage applies in cases of negligence, reckless conduct, or willful misconduct by the renter or any driver; violation of Chilean traffic regulations; use of the vehicle in breach of the rental agreement or these Terms; or failure by the renter to comply fully with the incident reporting obligations set out in Section 17. Non-compliance may render all applicable coverages void, in which case the renter bears full personal liability for all resulting costs. 10.3 Included Coverages Coverage — Deductible • Civil Liability — mandatory third-party coverage up to 1,000 UF — No deductible • Vehicle Damage — 15 UF + VAT • Collision — under responsibility of the contracted driver — 15 UF + VAT • Rollover — under responsibility of the contracted driver — 15 UF + VAT • Theft — 15 UF + VAT 10.4 Items Expressly Not Covered The following are not covered under any included insurance coverage. Damage, loss, or replacement costs for these items are charged in full to the renter: • windshield, glass, and locks • mirrors • keys • tires and rims

11. Vehicle Use

The renter is responsible for the lawful, appropriate, and careful use of the vehicle. The following are strictly prohibited: • subleasing, lending, or transferring the vehicle to any unauthorized third party • use for commercial passenger transport, rideshare, or delivery services • participation in races, rallies, or illegal activities • operation by any person not named as an authorized driver in the rental agreement • overloading beyond manufacturer specifications • driving under the influence of alcohol, drugs, or any substance that impairs ability • use on unpaved, off-road, or unsuitable terrain, unless expressly authorized in writing by RentCarChile Breach of any of the above voids all applicable coverage and may result in immediate termination of the rental agreement without refund.

12. Cross-Border Travel

Cross-border travel is not included in the standard monthly rental and requires a specific cross-border permit purchased as an additional paid service prior to the rental start date. The permit must be requested, confirmed in writing, and paid before the vehicle is delivered. Travel outside Chilean territory without a valid cross-border permit constitutes a material breach of the rental agreement, immediately voids all coverage without exception, and renders the renter fully and personally liable for all resulting damages, fines, legal costs, and consequences.

13. Vehicle Availability and Substitution

Vehicle models and versions are subject to availability. If the reserved vehicle is unavailable at delivery, RentCarChile may provide a vehicle of the same or higher category. RentCarChile will not substitute a lower-category vehicle without the renter's prior written agreement. When a substitute vehicle is provided, the agreed rental rate remains unchanged.

14. Maintenance, Breakdown, and Periodic Inspection

14.1 Scheduled Maintenance If scheduled maintenance is required during the rental period, the renter must follow the instructions provided at vehicle handover. RentCarChile will coordinate any required service. 14.2 Breakdown In the event of mechanical failure not attributable to misuse or driver fault, RentCarChile will make reasonable efforts to arrange roadside assistance or a replacement vehicle. Replacement vehicles are subject to availability and are not guaranteed within a specific timeframe. 14.3 Periodic Vehicle Inspection For rentals exceeding sixty (60) consecutive days, RentCarChile will conduct a mandatory vehicle inspection every 60 days or every 7,000 kilometers, whichever occurs first. The renter will be notified in advance and must make the vehicle available for inspection at the agreed time and location. Cooperation with periodic inspections is a contractual obligation. Refusal to present the vehicle for inspection constitutes a breach of the rental agreement.

15. Rental Extensions

Extensions are subject to vehicle availability and must be requested before the current rental end date through official RentCarChile channels. RentCarChile has sole discretion to approve or reject extension requests. Approved extensions are subject to rates in force at the time of the request — the original contracted rate is not guaranteed. Full payment for any extension is due within 24 hours of written confirmation. Non-payment entitles RentCarChile to require immediate vehicle return.

16. Early Return

Early return does not automatically entitle the renter to a refund for unused days. RentCarChile may recalculate the applicable rate based on the actual rental duration at the standard rates for that period, which may exceed the monthly rate. Specific conditions governing early return are stated in the signed rental agreement.

17. Accident, Theft, Robbery, or Any Incident

17.1 Immediate Reporting to Authorities In the event of any accident, theft, robbery, vandalism, or incident affecting the vehicle or involving third parties, the renter must immediately report the event to Carabineros de Chile or the competent authority and obtain the corresponding police report or official complaint. This obligation applies regardless of the apparent severity of the incident. 17.2 Sworn Statement to RentCarChile Within 24 hours of the incident, the renter must submit a complete sworn statement to RentCarChile including: • full name, RUT or ID number, phone, and address of all third parties involved • license plate, make, model, and color of all other vehicles • insurer and policy number of third parties, if available • exact location, date, and time of the incident • detailed description of events and circumstances • names and contact details of any witnesses • photographs or other available evidence of the scene and damages 17.3 Consequences of Non-Compliance Failure to comply fully and on time — including any omission, inaccuracy, or concealment — entitles RentCarChile to hold the renter fully liable for all resulting costs, including vehicle damage, third-party claims, deductibles, towing, storage, loss of use, and legal fees. All applicable coverages become void in case of non-compliance.

18. Vehicle Return

The vehicle must be returned on the agreed date, time, and at the agreed location, in the same condition recorded in the Delivery/Reception Form signed at handover. Any difference in condition not covered by contracted insurance will be charged in full to the renter. The renter is solely responsible for removing all personal belongings at return. RentCarChile accepts no liability for items left in the vehicle.

19. Additional Charges

19.1 Late Return Any return after the agreed return date and time is treated as a late return. RentCarChile may charge each additional day at the standard daily rate in force for the vehicle category at the time of the rental, without applying any monthly, promotional, corporate, or special-rate discount. RentCarChile may, at its sole discretion, apply a short courtesy margin in justified cases; doing so does not waive RentCarChile's right to charge for late return. If the delay exceeds RentCarChile's operational tolerance, the late return may also be treated as unauthorized retention of the vehicle, with the consequences set out in these Terms and in the rental agreement. 19.2 Fuel The vehicle must be returned with the same fuel level recorded at delivery. If the vehicle is returned with a lower fuel level, RentCarChile will charge a refueling surcharge ranging from CLP 45,000 to CLP 165,000, depending on the vehicle category and the missing fuel volume, in addition to the cost of the missing fuel itself. If the vehicle is returned with a higher fuel level than at delivery, no refund or compensation is issued for the additional fuel. 19.3 Cleaning The vehicle must be returned in reasonably clean condition. If extraordinary cleaning is required — including excessive dirt, mud, sand, odors, stains, pet hair, biological residues, or any condition that prevents normal inspection — RentCarChile will charge a cleaning fee determined according to the actual condition of the vehicle, with a minimum of CLP 30,000 and up to CLP 400,000 when chemical or specialized cleaning is required. If the vehicle's condition prevents inspection, the inspection and the deposit refund will be postponed until adequate cleaning is completed. 19.4 Uncovered Damages Damage to items not covered by insurance — including windshield, glass, locks, mirrors, keys, tires, and rims — will be assessed at return and charged in full based on documented repair or replacement costs. 19.5 Fines and Traffic Penalties The renter is solely responsible for all fines, penalties, and administrative charges arising during the rental period, regardless of when notification is received, provided the underlying event occurred while the vehicle was in the renter's custody. The renter irrevocably authorizes RentCarChile to charge such amounts to the registered payment method or deduct them from the security deposit, including after the rental agreement has ended.

20. Customer Liability

The renter is personally and fully liable for: • all vehicle damages not covered by contracted insurance, including applicable deductibles • damages caused to third parties or third-party property not covered by contracted insurance • all fines, penalties, tolls, and administrative sanctions incurred during the rental period • loss of or damage to keys, documents, accessories, or equipment • all costs arising from misuse, unauthorized use, or breach of these Terms • towing, storage, and recovery costs attributable to the renter's actions or omissions Where the deposit or registered payment method is insufficient to cover total amounts owed, the renter remains personally liable for the outstanding balance, immediately due upon notification by RentCarChile.

21. Modifications

RentCarChile reserves the right to update these Terms and Conditions at any time. Changes are published on the official website and do not affect reservations already confirmed in writing prior to the modification date, unless required by applicable law.

22. Governing Law and Jurisdiction

These Terms and Conditions are governed exclusively by the laws of the Republic of Chile. Any dispute arising from or in connection with these Terms or any monthly rental agreement shall be submitted to the exclusive jurisdiction of the competent courts of Chile.
